I. Preliminary provisions

This document defines the terms and conditions of sale in the Online Store under the name Madelle Store operating via a website available on the Internet at www.madelle.pl (hereinafter referred to as "Madelle Store"), run by Madelle Magdalena Magnon with its registered office in Połaniec, at: ul. Krakowska Mała 15, 28-230 Połaniec, NIP 866-166-40-43 (hereinafter referred to as the "Seller").

These Terms and Conditions ("Terms and Conditions") are addressed to all users of the Madelle Store - it defines the rules for registering and using the Madelle Store account, the rules for making an electronic reservation of products available at the Madelle Store, placing orders at the Madelle Store, as well as the rules for concluding Sales Agreements.

Each user placing an order (hereinafter referred to as the "Customer") at the Madelle Store is obliged to read and comply with the provisions of the Terms and Conditions.

These Terms and Conditions are available at the Madelle Store website, in a form that allows downloading, saving its version on a carrier of your choice and printing.

The personal data administrator is Magdalena Magnon, running a business under the name Madelle Magdalena Magnon, ul. Krakowska Mała 15, 28-230 Połaniec.

II. General provisions

The Seller sells goods in the form of clothing and accessories (hereinafter referred to as "Goods"). Information on products at the Madelle Store, among others, descriptions and prices constitute an invitation to submit an offer to conclude a sales agreement within the meaning of Article 71 of the Polish Civil Code, in accordance with these Terms and Conditions. The goods in the Madelle Shop are marked in detail. The Website contains information about the properties of the product, its price and the material from which it is made. The Seller shall exercise due diligence so that the presented photos of the offered Goods are reliable and reflect their actual condition. Any slight colour differences that may occur between the web presentation and the appearance of the original result from technical reasons and the Seller does not bear any responsibility for them. In case of any doubts related to the online presentation of the Goods, please contact the Seller via e-mail or telephone.

III. The prnciples of using the Madelle Store

The Madelle Store allows you to buy goods offered by the Seller via the electronic network. In order to use the Madelle Store, it is necessary for the Customer to have an active e-mail account. A customer who does not have an active e-mail account is not entitled to claim for impossible access to the Madelle Store. The sales agreement is concluded between the user of the Madelle Shop ("Customer") and Madelle Magdalena Magnon with the seat in Połaniec. The customer is entitled to use the Madelle Store resources only for his own use. It is not permissible to use the resources and functions of the Madelle Store in order to conduct a commercial activity by the Customer or which would infringe the interests of the Seller. The customer may create an account by making a free registration. The registration form contains fields that must be completed in order to create an individual Account through which the Customer can place orders. Login and password to the account are confidential. The customer is obliged to provide real personal data during registration.

The Madelle Store customer is obliged not to:

- supply or forward content prohibited by law;

- Use the Madelle Store in a way that interferes with its functioning;

- send unsolicited commercial information as part of the Madelle Store;

- Use the Madelle Store in a manner that is inconvenient for other Customers and for the Administrator of this store is obliged not to;

- use content posted on the Madelle Store website for other than personal use;

- use the Madelle Store in a manner inconsistent with the provisions of the law, provisions of the Terms and Conditions, as well as with the general rules of internet usage.

IV. Conclusion of the sales agreement

In order to conclude a sales agreement, you must place an order on the Madelle Store website (on-line). The Madelle Store accepts on-line orders 24 hours a day, seven days a week. Orders placed on non-working days will be executed on the first working day following the day on which the order was placed. The Customer may place an order via an Account or by submitting a one-off Order without making a Registration. The condition to place an order is to read and accept the provisions of these Terms and Conditions and the Customer's consent to the processing of his personal data provided when ordering to process and service the order placed in the Online Store. This consent is voluntary, however, it is necessary to place an order. In order to place an order, you must select products from the available Madelle Shop offer, their colors, sizes and quantities by adding them to the basket. Sending the order by the customer (confirmation with the "Place an order" button) constitutes the Customer's offer submitted to Madelle Magdalena Magnon with its registered office in Połaniec regarding the conclusion of the Sales Agreement, in accordance with the Terms and Conditions. After placing an order by the Customer, he will receive on the Online Store website and by e-mail a message containing information on the order number, the number of products, the value of the order, the selected type of delivery and payment as well as contact details of the Customer. The message is a confirmation of receipt by the Online Store of the Customer's purchase offer. The customer receives a confirmation of acceptance of his offer by e-mail ("Confirmation of order") to the e-mail address indicated by him. After receiving the above confirmation the agreement of sale of goods ordered by the customer is concluded. The Sales Agreement is concluded in Polish, with the content compliant with the Terms and Conditions. The Customer may change the order until the ordered Goods are shipped. The changes may concern the resignation of all or part of the Goods making up the order, changes in the delivery address or changes to the invoice details. In the event of a change in the order, the Customer should immediately contact the Madelle Store staff by phone or e-mail. In the event of cancellation of the order, if the payment has been made in advance, the refund will be made within fourteen (14) days from the date of receipt of the Customer's resignation. In the absence of the ordered Goods or when the ordered Goods are not available and it is not possible to execute the Customer's order, the Seller has the right to withdraw from the contract within twenty one (21) days from the date of its conclusion. If the Customer has paid for the Goods - the Seller will refund the Customer for the Goods within seven (7) days from the date of order cancellation. The Madelle Store reserves the right to refuse to process the order under the sales agreement if the contact details of the customer are incorrect, the transaction was not authorized in the PAYPAL or Przelewy24 electronic payment system or the payment for the order was not paid within the specified time.

V. Delivery and Collection

Orders are delivered via courier or Poczta Polska to the address indicated in the order by the customer. The Seller proceeds to execute the order immediately after authorisation of payment transfer for the order placed on the Madelle account, or in the case of electronic payments - after the positive authorization of the payment on the PAYPAL or Przelewy24 account. The total and maximum order completion time should not exceed fourteen (14) business days, and in no case thirty (30) days from the date of the sale contract. The cost of shipping the purchased Goods shall be borne by the Customer in the amount of: Domestic delivery cost - PLN 15; The cost of shipment to EU countries - PLN 70; Shipping cost to non-EU countries - determined individually. The cost of delivery determined individually depends on the country of delivery and the weight of the shipment. The Seller shall not be liable for failure to deliver the order or delays in delivery caused by a faulty or inaccurate address given by the Customer. The Seller attaches to each item sent proof of purchase in the form of a fiscal receipt or a VAT invoice. When collecting the parcel delivered by the courier, the customer should check carefully in the presence of the forwarder the completeness of the contents of the package and the condition of the outer package and the ordered goods. In the case of damage to the shipment, the Customer should prepare a damage report together with the courier, in two identical copies signed by the Recipient and the courier. In the absence of the Customer at the address indicated by him and the return of the ordered Goods to the Madelle Store by the Supplier, the Seller will contact the Customer by email or telephone, determining the date and cost of the Delivery with the Customer again.

VI. Prices and forms of payment

Information on the purchase price of the goods in the Madelle Store is provided on its website. The given prices are binding at the time of placing the order by the customer. All prices listed on the Madelle Store website are gross prices in Polish zlotys. Quoted product prices do not include the cost of delivery.

The customer can choose the following methods of payment for the ordered Goods and the fees for the delivery of ordered goods:

  • Payment with PAYPAL system
  • Payment by electronic means via the Przelewy24 online payment service

In the case of payment made through the payment service, the positive transaction authorization is a condition for completing the order. If you choose to pay by bank transfer to the Seller's bank account, the order will be processed after the funds have been credited to the Seller's bank account. The order number should be given in the transfer name. No receipt of payment on the account of Madelle or intermediaries in the transaction (PayU and Przelewy24) within 7 days of placing the order will result in the order being canceled. In this case, the customer may re-place the order.

The Madelle Store reserves the right to change the prices of the Goods in the Madelle store, introduce new Goods for sale, carry out and cancel promotional campaigns on the Madelle Store's websites or make changes to them in accordance with the Civil Code and other acts, but these changes will not affect rights of persons who have entered into sales agreements for the Goods offered in the Madelle store before the above-mentioned changes.

VII. Complaints

Pursuant to the Act of 27 July 2002 on Special Terms and Conditions of Consumer Sale and Amendments to the Civil Code (Dz. U. of 2002 No. 141, item 1176 as amended) The seller is liable to the Customer, who is a consumer, within the meaning of Article 221 of the Civil Code for non-compliance with the sales agreement concerning Goods purchased by this consumer. In the case of customers who are not consumers, the Seller is liable according to the rules set out in the Civil Code. The Customer may lodge a complaint against any item purchased from the Madelle store with due dates and conditions of complaint if it has defects that constitute its non-compliance with the Sales Agreement. Complaints should be submitted via email to madelle@madelle.pl, and the Goods should be delivered to the Seller to the following address: Madelle Magdalena Magnon, ul. Jana Kazimierza 28/164, 01-248 Warszawa, with the inscription: "Madelle Complaint". A properly submitted complaint should contain the Customer's details (including his name, surname, postal address, e-mail address, telephone number) and a description of the problem being the basis for lodging a complaint. The Seller will consider the complaint within fourteen (14) working days from the date of receipt of the shipment containing the Goods complained about. The information about the method of handling the complaint will be forwarded to the Customer via e-mail to the Customer's e-mail address. The Seller is not liable for damages resulting from misuse of the offered products. Slight differences in colour between the web presentation and the original result from technical reasons and cannot be the subject of a complaint. Damage of a shipment during transport will be taken into account only on the basis of a report made to an employee of a courier company or Poczta Polska at the time of delivery. In the event of a positive settlement of the complaint, the Seller will send a product of full value (repaired or new) within 14 days from the positive settlement of the complaint, and if it proves impossible, the Seller will offer the Customer another product constituting a substitute for the defective Goods or refund the full amount of the price paid. The Seller shall refund the payment using the same method of payment which the consumer used, unless the consumer has expressly agreed to a different way of return, which does not incure any costs for him or her. If the complaint is not accepted, the goods will be sent back together with the opinion that the complaint is not valid.

VIII. Withdrawal from the Sales Agreement

All Goods offered in the Madelle store are new and hand-made. The Customer has the right to withdraw from the Sales Agreement without giving a reason within 14 days from the date of receipt of the Goods. The condition to take into account the return is submitting within 14 days from the date of receipt of the Goods a written statement of withdrawal from the concluded Sales Agreement by email to the address madelle@madelle.pl or by post to the address Madelle Magdalena Magnon, ul. Jana Kazimierza 28/164, 01-248 Warszawa. The statement of withdrawal from the Sales Agreement may be submitted using the form template that has been attached to the Terms and Conditions. The Customer is obliged to return the Goods to the Seller to the correspondence address indicated in the Terms and Conditions within 14 days from the date of the withdrawal from the Sale Agreement. This deadline will be met if the Goods are sent back before the deadline expires. The original proof of sale (bill) should be attached to the returned Goods. Returned goods must be in the "as new" condition. Delivered Goods must be complete, clean and have tags. If the Goods are returned in accordance with the Terms and Conditions, the Seller shall return the payment for the Goods and shipping costs within a maximum of 14 business days from the date of receipt of the returned Goods. The Seller shall refund the payment using the same method of payment as the Customer used. Products made to individual order (made to measure) are not exchangeable and refundable. The cost of returning the Goods to the Seller shall be borne by the Customer. The seller does not accept any parcels labelled cash on delivery.

IX. Copyrights

The Seller is entitled to all proprietary copyrights to the content of the Online Store websites and it is subject to legal protection.

X. Privacy policy and personal data security

The Personal Data Administrator is responsible for the lawful processing of personal data, for the principles of collecting, processing and storing personal data, as well as the rights of the Buyer related to his personal data. The Personal Data Administrator processes personal data of Buyers based on consent and in connection with the legitimate interests of the Seller.

The Personal Data Administrator collects and processes personal data only to the extent that it is justified by a contractual or legal obligation.

The Customer's consent to the processing of personal data is voluntary, and consent to the processing of data for a particular purpose may be withdrawn at any time.

For the purpose of the Customer's order, the following personal data are collected: postal address - necessary to issue a proof of purchase; address of the place of delivery of goods - necessary to address the parcel; e-mail - necessary for communication related to the implementation of the order; telephone number - necessary in the case of selection of some types of delivery

Detailed solutions regarding the protection of personal data related to placing an order, but also using the store before and after placing an order, are included in the Privacy Policy, which is an integral part of these Terms and Conditions.

XI. Final Provisions

These Terms and Conditions constitute an integral part of the Sales Agreements concluded by the Seller with the Customers. The Seller reserves the right to amend the Terms and Conditions at any time. Amendments to the Terms and Conditions are effective from the moment they are published on the Online Store website. Amendments to the Terms and Conditions may not violate the acquired rights of customers using the Online Store. The Seller reserves the right to change the prices and quantity of goods in the Online Store, withdraw or introduce new products for sale, carry out and cancel promotional campaigns, as well as their modification on the Online Store website or make changes to them in accordance with the Civil Code and other acts, where such changes do not violate the rights of persons who have entered into sales agreements concerning goods offered by the Online Store before the above-mentioned changes.

The Seller shall takes steps to ensure that the Store operates properly, to the extent resulting from its current technical knowledge and undertakes to remove any irregularities reported by Customers within a reasonable time period.

In matters not regulated by these Terms and Conditions, the provisions of the Civil Code or other acts applicable to the operation and functioning of the Online Store in force in the Republic of Poland shall apply. The competent court for resolving disputes is the Common Court having jurisdiction according to the applicable law.
